Hey all,

Unfortunately the company I work for has decided to move from Luxembourg. They have agreed to pay the 2 months notice of course but it seem like they will not pay for authorized overtime. In my case it is quite a lot - just since end of June it comes to over 7000 Euro before tax. Anyone know what can be done and who I can turn to?

Thanks!

You must send to your employer:

1) Requête en référé (if he aknowledges in principle that he must pay) 2) Requête au fond (if he does not do that)

In the case of 2), it is the best way for you asking the union or some lawyer for advice and/or support. The 2nd way could consume quite a lot time, and also money, I suppose. But even better than loosing all the money, perhaps.

Thanks Meffo - you are a star! So to the most boring question you get all the time. As I live in germany - i have to get the german arbeitslosengeld (unfortunately). Do you have any idea how this is calculated? I will get the 301 form (I think thats what its called from ADEM) and then go to Arbeitsamt as quick as possible. I have worked full time since June 2005 in Luxembourg (however I have never worked and do not have a Lohnsteuerkarte in Germany - I moved to germany from Sweden when I got my job in Luxembourg). My brutto gehalt is 2878 Euro/month and 2335 Euro Netto. What will I get AFTER tax in Arbeitslosengeld in Germany? I did use Lycos Arbeitslosengeld rechner and it came to 1500 Euro/month after tax. To me that is not THAT bad....what do you say??

Do you know what I have to bring to Arbeitsamt except for the 301 form and my ID?

Sorry - must have miscalulated - now it comes to 1059/month...YIKES! So then it is not 60% of your netto gehalt? It is so confusing...

You must phone instantly !!! to "Agentur für Arbeit" which is competent for your residence, If you wait, you risk loosing money: http://www.arbeitsagentur.de/nn_25986/zentraler-Content/A04-Vermittlung/ A042-Vermittlung/Allgemein/Arbeitsuchendmeldung.html

01801 - 555 111 http://www.arbeitsagentur.de/ nn_25650/Navigation/zentral/Buerger/Arbeitslos/Alg/Alg-Nav.html

Mit E 301 im Ausland erworbene Versicherungs- und Beschäftigungszeiten nachweisen, http://www.arbeitsagentur.de/nn_190930/Navigation/zentral/Buerger/Arbeitslos/ Alg/Internationales/Internationales-Nav.html

The calculation is a rocket science, Der Leistungssatz beträgt 67 % beziehungsweise 60 % des pauschalierten Nettoentgeltes (Leistungsentgeltes). (But what is that in your case?!) http://www.arbeitsagentur.de/nn_25698/Navigation/zentral/Buerger/Arbeitslos/Alg/ Dauer-Hoehe/Leistungssatzes/Leistungssatzes-Nav.html

Be happy, taking the confusion a step farther ...
